California Legalizes Gay Divorce

The first legally-divorced gay couple in California celebrate the end of their 12-minute, dysfunctional marriage.
In a landmark decision today, the California Supreme Court ruled today that gay couples have the constitutional right to a divorce.
At the heart of the case was the very definition of “divorce”: Opponents of gay divorce believe divorce is a sacred cultural institution which marks the break of a poorly-thought-out bond between a man and a woman; proponents, however, argue that divorce is essentially an expression of mutual hatred by two miserable people, whatever the gender.
“This is about two human beings who hate each other very, very much,” said a lawyer representing a coalition of gay rights organizations. “The hatred is there, and it’s real.”
California already has a strong domestic separation law that provides gay couples with nearly all the practical inconveniences and deep heartbreak experienced by heterosexual couples who have a divorce. But the Supreme Court today said that is not enough.
“Words matter,” said Chief Justice Ronald M. George. “‘Domestic separation’ does not, and cannot, capture the depth and intensity of the hatred felt by gay couples.”
Gay rights organizations, while heartened by the decision, are far from content with the ruling. According to a statement released by gay people:
“This ruling marks a victory for gay divorce activists everywhere. However it is not enough: The right to divorce is still not available to huge swaths of the American population who nonetheless have someone for whom they hold a burning hatred. For example, people who aren’t married.”
